Client Agreement

SESSION FEE: Your session fee is required to secure your Session. This fee confirms and holds the sitting appointment and enables the studio to schedule and allocate the required resources. This fee is non refundable if you cancel or don't show up. Payment is required at the phone call and can be paid over the phone via Credit or debit Card.

PLEASE BE ON TIME FOR YOUR SESSION:Your photo session is booked for a specific start and end time so I can give you the very best experience without rushing. Please plan to arrive about 5 minutes early so we can start right on time. If you arrive too early, please be prepared to wait until your scheduled session begins.

If you arrive late, your session will still end at the originally scheduled time. Unfortunately, this means we may have less time to create your images, and late arrivals can limit outfit changes, backgrounds, and variety.

If you are more than 30 minutes late, your session will incur a rebooking fee of $250+GST to cover studio costs, time and preparation. If rescheduling is not possible on the same day, your booking will be treated as a cancellation.

I want your session to be a relaxed, enjoyable experience — arriving on time means we can create something truly beautiful for you.

BOOK OUT THE WHOLE DAY FOR YOURSELF: Hair and makeup will take approximately 1 hour so come prepared to be pampered for a while! Your session itself will take approximately 1 hour. Editing takes 45 minutes Viewing and Ordering can last up to 2 hours dependant on how well you can make decisions.

POSTPONING YOUR SESSION:

Sometimes things out of our control happen and we need to postpone, that's not a problem if you give us plenty of notice, however, forgetting about your session and letting us know at the last minute has a huge impact on our studio therefore it will incur a rebooking fee of $250+gst (with the exception you are prepared to go on a waiting list and wait for a space to become available), so please make sure when you book the session that you can make it and lock it in your diary! We will be sending you a reminder.

ATTENTION: Bollard Road Studio Clients:

If you reschedule there is a rebooking fee $250+GST to cover the cost of the room booked out for you with the exception, if you can find someone to take your space or you are prepared to go on the waiting list for a space to become available.

CANCELLING YOUR SESSION:

In the event of a session cancellation, any fees paid will NOT be refunded. This policy is in place to cover the costs associated with reserving your session space and the potential loss of income for Helenjoy Photography due to the vacancy.

VIEWING AND ORDERING:

After your session we will make an appointment for you to view your images. At this time you can make your selection and place your order for the images you wish to purchase. All financial persons need to be present at this session. If they can't make the appointment, then it needs to be rescheduled.

PAYMENT TERMS:

Payment, Production & Refund Policy

All photographic products sold by Helenjoy Photography are custom-made, bespoke items created specifically for each client. As such, once payment has been made, the order immediately enters production.

Change of Mind / Refunds

• No refunds are available for change of mind once payment has been made.

• Bespoke photographic products cannot be cancelled, refunded, resold, or transferred to another person.

• If a client changes their mind after payment, a studio credit may be offered at our discretion. Studio credits are non-refundable and non-transferable.

Payment Options

• Option 1: Payment in full at the time of the viewing appointment.
  Accepted payment methods include EFTPOS, Credit Card, PayPal, or Cash.

• Option 2: Up to 12 months interest-free instalment payments through our partnered finance companies.
  Finance must be approved and fully arranged prior to the photo session.

Production & Delivery

• Artwork production commences only once full payment has been received.

• Standard production time is approximately 6 weeks from the date of full payment, unless otherwise specified.

• Albums and books are handcrafted products and may require additional production time.

By proceeding with a purchase, the client acknowledges and agrees to these terms.

COLLECTION APPOINTMENT: The order is to be collected within two weeks of notice and can be collected at the studio between Wednesday and Friday 10am to 6pm.
Collection is for quality assurance purposes, should you wish to have them delivered there will be an additional cost for packaging and handing. Helenjoy Photography takes no responsibility for any damage that may occur through delivery. This is at the customer's sole risk. Please note we work really hard to insure you get your order out on time and we do not have storage facilities so please respect this by picking up your order as soon as you can and to avoid storage fees being charged.

Clients who have placed orders at the Bollard Road location will be contacted and given a specific date for collection.

If you are unable to collect your order on the scheduled date, you will need to arrange courier pickup at your own cost and risk. Please ensure timely collection or courier arrangement to avoid delays or additional storage fees.

DECLAIMER
I/We further acknowledge that the Client will not be compensated, either now or at any time in the future, for any use of the photographs.

I/We acknowledge and agree that the Photographer shall have the exclusive, perpetual, and irrevocable right to take, use, re-use, publish, and republish photographs which contain the Client’s image.

I/We hereby acknowledges and agrees that the Photographer may modify, change, or alter such images without restriction. 

I/We hereby acknowledge and agree that the photographs created by the Photographer shall become and remain the exclusive property of the Photographer, and that the Client will have rights to share the photographs indefinitely.

I/We, also hereby waives all rights and claims and releases the Photographer from any claim or cause of action, whether now known or unknown, relating to the sale, display, assignment, license, and use, of any kind whatsoever, of the photos.

I/We hereby covenants and agrees that the Client shall not bring any action or proceeding or maintain a complaint against the Photographer in any court of law, state or local, or before any administrative body, related in any way whatsoever, to the use of the photographs. 

I/We understand that all care and diligence will be exercised in the performance of the photography by Helenjoy Photography, but that any liability is limited to monies paid, should computer failure, accident or any other mishap occur that prevents fulfilment of this undertaking.

I/We also understand that we are totally responsible for ourselves and the safety and well-being of any children.

I/We also understand that I am not allowed to take photographs either during the session or at the viewing appointment without permission.

I/We agree that any photographs taken by the studio, may be used for the studio's advertising, promotion and exhibit purposes. authorizes the Photographer, and/or any assignees and licensees, to use and to create images, and any reproduction of them in any form in any media whatsoever, for promotional materials, online marketing, port, and other areas of marketability.  The Client further authorizes the distribution of photographs to potential clients of the Photographer for demonstration purposes, and authorizes the inclusion of such images in a Photographer portfolio.

I/We agree and understand that the photos will be taken digitally.
